1. About These Terms
This website (www.bushratheweb.com) is operated by Bushra (referred to as “I,” “me,” or “my”). I provide WordPress development services and local SEO services. By accessing this site or hiring my services, you agree to these Terms and Conditions.
2. No Company – Sole Proprietor
I am an individual freelancer and sole proprietor. There is no separate legal company. All rights, liabilities, and obligations under these terms are personal to me.
3. Services Offered
- WordPress development (custom themes, plugins, site setup, maintenance, fixes)
- Local SEO (Google Maps optimization, local keyword targeting, citation building, GMB setup, etc.)
Detailed scope of work will be defined in a separate project agreement or invoice for each client.
4. Payment Terms (100% Upfront)
- Full payment (100%) is required before I start any work on your project — whether it’s WordPress development or local SEO services.
- No work will begin until the full amount is received and cleared.
- Payments are made via [bank transfer / UPI / PayPal / Razorpay / etc. – please specify your method].
- This policy protects me from clients who disappear or “ghost” after work is completed.
- All fees are non‑refundable once work has commenced (see refund policy below).
And to match this, here is the updated Refund & Cancellation Policy (Section 5)—because with 100% upfront, you still need a fair but clear refund rule:
5. Refund & Cancellation Policy
For monthly SEO retainers, you may cancel with 15 days’ written notice, but the current month’s fee is non‑refundable if work has already been performed in that month.
You may cancel a project within 24 hours of making the full payment and before any work has started, and you will receive a 90% refund (10% deducted for payment gateway/admin charges).
Once I have started any work (e.g., initial setup, keyword research, design, code, or consultation), no refund is given.
6. Delivery Timeline
I provide estimated delivery dates, but delays may occur due to technical difficulties, client feedback delays, or third‑party dependencies. I am not liable for any business losses caused by delayed delivery.
7. Intellectual Property
- WordPress development: After full payment, you own the final code (theme, customizations) that I create specifically for you. I retain the right to reuse generic code snippets, libraries, and my development tools.
- Content you provide (text, images, logos) remains your property.
- SEO work: Reports, keyword research, and strategies shared with you are for your internal use only. You may not resell or share them publicly.
8. No Guarantees for SEO Results
Local SEO depends on many factors (competition, Google algorithm updates, your business category, etc.). I will use best practices, but I do not guarantee specific rankings, number of leads, or page one positions. I cannot control Google or other search engines.
9. Client Responsibilities
You agree to:
- Provide all necessary access (WordPress admin, hosting, Google Search Console, GMB, etc.) in a timely manner.
- Please respond to my queries within 3 business days to avoid project delays.
- Ensure you have the legal right to use any third‑party plugins, images, or content you ask me to install.
10. Limitations of Liability
To the maximum extent permitted by law:
- I am not liable for any indirect, incidental, or consequential damages (e.g., lost revenue, data loss, or business interruption).
- My total liability for any claim related to my services is limited to the amount you have paid me for that specific project in the last 6 months.
- 11. No Warranty on Third‑Party Products
- I may recommend or install third‑party themes/plugins (e.g., Elementor, Yoast, WooCommerce). I am not responsible for bugs, security issues, or compatibility problems caused by those third‑party products.
12. Data Privacy & Confidentiality
- I will not share your client data, login credentials, or business information with anyone else.
- I may use project screenshots or a link to your site in my portfolio only after taking your written permission.
13. Force Majeure
I am not liable for delays or failure to perform due to causes beyond my reasonable control (e.g., internet outage, hosting failure, natural disaster, illness, or government restrictions).
14. Dispute Resolution
Governing law: England & Wales. Disputes will first be resolved amicably, then through online arbitration (video call). No court action without attempting arbitration first.
15. Changes to These Terms
I may update these terms at any time. The latest version will always be posted on this page. Continued use of my services after changes means you accept the new terms.
